The Supervisory Scope and System Construction of Administrative Procuratorial Supervision

Although the development of administrative procuratorial supervision has made remarkable progress, its theoretical framework and institutional design still present weaknesses. The scope of administrative procuratorial supervision encompasses all administrative activities and administrative proceedings. Supervisory relief initiated upon application shall follow the principle of complementarity, while procuratorial supervision initiated ex officio shall follow the principle of modesty and restraint. In principle, neither form of supervision is subject to time limits. The primary function of administrative procuratorial supervision is to conduct investigations, file protests, offer recommendations, and provide rights relief to restore and maintain a sound legal order through the inspection of administrative law enforcement activities.
